OFFICE MEMORANDUM
Subject:- Introduction of Annual Medical Examination for the Group ‘A’ officers of Central Civil Services of age 40 years and above.
The undersigned is directed to say that a scheme of Annual Medical Check-up is already operating in respect of All India Service officers. This Department had taken up the issue of covering Group A’ officers of Central Civil Services/posts for Annual Medical Check-up in consultation with the Ministry of Health and Family Welfare and the Ministry of Finance (Department of Expenditure). It has now been decided that Group ‘A’ officers of Central Civil Services/Posts of and above the age of 40 years will be covered by the Annual Medical Check- up scheme. The following package rates for the above purpose have been approved:-
(i) Annual Medical Examination of Men officers- Rs. 2000/-
(Rupees Two Thousand only)
(ii) Annual Medical Examination of Women officers- Rs, 2200/-
(Rupees Two Thousand and Two Hundred only)
2. The regime of medical tests for the above purpose will be as given in the ANNEXURE-I.
3. The Ministry of Health and Family Welfare has informed that the above rates were offered to CGHS empanelled private hospitals in Delhi and NCR and the 26 hospitals given in ANNEXURE-II have accepted the offer and agreed to conduct the AnnualMedical Examination of the Group ‘A’ Officers of Central Civil Services of 40 years and above. The Ministry of Health and Family Welfare is in the process of empanelling hospitals in other CGHS cities on the same terms and conditions. In non-CGHS cities the offer is being made to the hospitals recognized under CS(MA) Rules, 1944. Ministry of Health and Family Welfare has indicated that it will require atleast three months time for empanelling the hospitals for other places outside Delhi/NCR where CGHS/CS(MA) recognized hospitals are available. This will be communicated later. There are places where there are no empanelled hospitals. In such places, the administrative Departments/offices may engage quality local hospitals on the same terms and conditions to get the Annual Medical Examinationof their officers conducted subject to ceiling of Rs.2000/- and Rs.2200/- for men and women officers respectively or actual whichever is less.
4. All Ministries/Departments are accordingly requested to cater the estimated expenditure in their budget for reimbursement of the amount to the concerned officer and implement the scheme during the financial year 2012-13 for the officers located in Delhi and NCR. Instructions with respect to officers located outside Delhi/NCR where CGHS/CS (MA) recognized hospitals are available would follow. The concerned officer may be handed over the copy of complete Medical Report and the summary of the Medical Report in the enclosed proforma (Annexure-III) separately prepared by the Medical Authority is to be attached to the APAR of the concerned officer.

Relaxation in Norms for Appointment as Teacher under SSA – Centre asks states to expedite recruitment of Teachers to achieve RTE Target



The Government has given consent to thirteen states who had sought permission to relax minimum qualification for appointment of teachers under Sarv Shiksha Abhiyan. The States are: Assam, Manipur, Meghalaya, Nagaland, Tripura, Bihar, Chhattisgarh, Himachal Pradesh, Madhya Pradesh, Odisha, Uttarakhand, Uttar Pradesh and West Bengal.
The relaxation was sought, due to the non-availability of teachers possessing minimumqualifications as laid down by the National Council for Teacher Education, under the Right of Children to Free and Compulsory Education Act, 2009.
To address this issue, the Government has sanctioned over Rs. 6300 crore project to strengthen Teacher Education in the country during the 12th Plan. The main components of the revised Scheme are the setting up of new District Institutes of Education and Training (DIETs), Colleges of Teacher Education (CTEs) and Institutes of Advance Study in Education (IASEs), as well as strengthening of existing DIETs, CTEs and IASEs. The scheme also envisages establishment of Block Institutes of Teacher Education (BITEs) in 196 identified SC/ST/Minority concentration districts as elementary pre-service teacher education institutes.
In addition, NCTE has given permission to respective State Governments for training of the over 5 lakh in service untrained teachers through distance mode.
Meanwhile, the Central Government has requested the State Governments and the Union Territories to expedite recruitment of teachers as well as to carry out the redeployment of existing teachers to ensure that all schools have pupil-teacher ratios as laid down under the Right of Children to Free and Compulsory Education (RTE) Act 2009. Under the Sarva Shiksha Abhiyan (SSA), 19.82 lakh teachers have been sanctioned to States/Union Territories against which 12.86 lakh teachers have been recruited till December, 2012. The State Government of Andhra Pradesh has recruited 38,319 teachers till date against the 39,189 teacher posts sanctioned to them under the SSA.

UNAUTHORISED ABSENCE FROM DUTY – CONSOLIDATED INSTRUCTIONS RELATING TO ACTION WARRANTED AGAINST GOVERNMENT SERVANTS REMAINING AWAY FROM DUTY WITHOUT – AUTHORISATION / GRANT OF LEAVE

Subject:- Consolidated instructions relating to action warranted against Government servants remaining away from duty without – authorisation/grant of leave — Rule position
The undersigned is directed to say that various references are being received from Ministries/Departments seeking advice/post facto regularisation of unauthorised absence. It has been observed that due seriousness is not being accorded by the administrative authorities to the various rule provisions, inter alia under the CCS(Leave) Rules, 1972, for taking immediate and appropriate action against Government servants staying away from duty without prior sanction of leave or overstaying the periods of sanctioned leave. It is reiterated that such absence is unauthorised and warrants prompt and stringent action as per rules. It has been observed that concerned administrative authorities do not follow the prescribedprocedure for dealing with such unauthorised absence.
2. In view of this, attention of all Ministries/Departments is invited to the various provisions of the relevant rules, as indicated in the following paragraphs for strict adherence in situations of unauthorised absence of Government servants. It is also suggested that these provisions may be brought to the notice of all the employees so as to highlight the consequences which may visit if a Government servant is on unauthorised absence. The present OM intends to provide ready reference points in respect of the relevant provisions, hence it is advised that the relevant rules, as are being cited below, are referred to by the competent authorities for appropriate and judicious application. The relevant provisions which may be kept in mind while considering such cases are indicated as follows:
(a) Proviso to FR 17(1)
The said provision stipulates that an officer who is absent from duty without any authority shall not be entitled to any pay and allowances during the period of such absence.
(b) FR 17-A
The said provision inter alia provides that where an individual employee remains absent unauthorisedly or deserts the post, the period of such absence shall be deemed to cause an interruption or break in service of the employee, unless otherwise decided by the competent authority for the purpose of leave travel concession and eligibility for appearing in departmental examinations, for which a minimum period of service is required.
(c) Rule 25 of the CCS (Leave) Rules, 1972
The said provision addresses the situation where an employee overstays beyond the sanctioned leave of the kind due and admissible, and the competent authority has not approved such extension. The consequences that flow from such refusal of extension of leave include that:
     i the Government servant shall not be entitled to any leave salary for such absence;
    ii the period shall be debited against his leave account as though it were half pay leave to the extent such leave is due, the period in excess of such leave due being treated as extraordinary leave
    iii wilful absence from duty after the expiry of leave renders a Government servant liable to disciplinary action.
With respect to (iii) above, it may be stated that all Ministries/ Departments are requested to ensure that in all cases of unauthorised absence by a Government servant, he should be informed of the consequences of such absence and be directed to rejoin duty immediately/ within a specified period, say within three days, failing which he would be liable for disciplinary action under CCS (CCA) Rules, 1965. It may be stressed that a Government servant who remains absent without any authority should be proceeded against immediately and this should not be put off till the absence exceeds the limit prescribed under the various provisions of CCS (Leave) Rules, 1972 and the disciplinary case should be conducted and concluded as quickly as possible.
(d) Rule 32(6) of the CCS (Leave) Rules, 1972
This provision allows the authority competent to grant leave, to commute retrospectively periods of absence without leave into extraordinary leave under Rule 32(6) of CCS (Leave) Rules, 1972. A similar provision also exists under rule 27(2) of the CCS (Pension) Rules, 1972. It may please be ensured that discretion allowed under these provisions is exercised judiciously, keeping in view the circumstances and merits of each individual case. The period of absence so regularised by grant of extra ordinary leave shall normally not count for the purpose of increments and for the said purpose it shall be regulated by provisions of FR 26(b(ii).
3. All Ministries/ Departments should initiate appropriate action against delinquent Government servants as per rules.

7TH PAY COMMISSION – CENTRAL GOVERNMENT EMPLOYEES PLEA FOR CONSTITUTION OF 7CPC SUPPORTED BY MINISTER SHRI. AJAY MAKEN
While demand for constitution of 7th Pay Commission getting stronger, Shri.Ajay MakenUnion Minister for Housing and Urban Poverty Alleviation has also given a support voice for formation of Seventh Pay Commission as Central Government Employees will be entitled for 7th CPC Pay with effect from 1.1.2016.
As per the Media reports, Shri.Ajay Maken has addressed a letter to Prime Minister Shri.Manmohan singh and pointed out that except sixth Pay Commission all earlier pay commissions were constituted in the third year of every decade. In other words earlier pay commissions except 6CPC were formed well before its implementations became due.
The Union Minister for Housing and Urban Poverty Alleviation has also observed in hisletter dated 14th March 2013 that setting up of 7th Commission was in larger interest ofGovernment Employees as well the Congress Party.

AJAY MAKEN BACKS CRY FOR SEVENTH PAY PANEL

With a little over a year to go before the next general election, the demand for a Seventh Pay Commission has started to gather momentum. Union housing and urban poverty alleviation minister Ajay Maken has taken the lead in endorsing the Central government employees’ request for setting up of the new pay panel, citing the erosion of real wages due to high inflation since implementation of the Sixth Pay Commission’s recommendations.
In a letter addressed to Prime Minister Manmohan Singh, Maken underlined how every pay panel since the Second Pay Commission, barring the Sixth Pay Commission, were set up in the third year of the decade. “We are again in the third year of the ongoing decade and Central government employees are justifiably looking forward to the Seventh Pay Commission,” he said.
Recalling that it was under Singh that the last pay panel was set up in 2005, after the NDA government failed to do so in 2003, Maken, in the communication dated March 14, requested that a decision be “taken on priority” for constitution of the Seventh Central Pay Commission. “A notification for constitution of the 7th Central Pay Commission is the need of the bour, which is bound to have bearing upon about 20 million employees,” he said.
Maken concluded by emphasizing that setting up of the new pay panel was in “larger interest of government employees as well as the (Congress) party”.

Some questions related to the above topic has been raised in the Rajya Sabha by the Hon'ble Member Shrimati Gundu Sudharani on 14th March, 2013. The concerned Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Shri V. Narayanasamy has submitted the answer in a written form as follows...

"As per Rule 2(h) of CCS (CCA) Rules ‘Government servant’ means a person who- 

(i) is a member of a Service or holds a civil post under the Union, and includes any such person on foreign service or whose services are temporarily placed at the disposal of a State Government, or a local or other authority; 

(ii) is a member of a Service or holds a civil post under a State Government and whose services are temporarily placed at the disposal of the Central Government; 

(iii) is in the service of a local or other authority and whose services are temporarily placed at the disposal of the Central Government".

The service conditions of the employees of statutory and constitutional bodies are regulated by the statute under which they are created.

As per the “Compendium of Welfare Programmes/Instructions of facilities”, the Central Government Employees and the employee of Delhi Administration, shall qualify for regular membership of Central Government Employees Welfare Association in receipt of the grant-in-aid from the Department of Personnel & Training. The Membership shall not be open to the employees of the private shops/companies, Bank, Autonomous Bodies, Public Sector Undertakings, New Delhi Municipal Committee, Municipal Corporation of Delhi and Bodies created by or under any specific Act of Parliament.
