As a part of mission towards bringing transparency and strengthening the Information (GPF Module) System of the O/o CGA this office has decided to expand the e-Samarth application to all PAOs of Civil Ministries, presently running in four PAOs of CISF, M/o Home Affairs and PAO (NIC).

2. e-Samarth. a web-based application, follows a very transparent approach in providing a comprehensive resource of GPF-related information through a website open to all account holders and accounting units. All account holders will be able to get the information regarding their GPF accounts directly from internet. The subscribers will be able to view the current status of their request for GPF Withdrawal, Advances, Final 
Payment, Deposit Linked Insurance Scheme (DLIS), and Transfer Out and balances,etc.

3. In the present system of maintenance of GPF accounts, new account number is allotted to the subscriber at the time of his first deduction towards GPF or at the time of his transfer from one office to another either within Ministry or inter-Ministry, resulting in holding of multiple account numbers by a subscriber with a possibility of GPF credits scattered over different accounting Units. In such cases, subscribers do not know what balance is lying in their accounts.

4. In e-Samarth application, a subscriber can view his/her GPF details through a unique number only. It is therefore mandatory to map all his/her existing account numbers through a Unique Key. It has been decided that PAN (allotted by Income Tax Department) would be treated as a Unique Key to map all the account numbers allotted to a subscriber.

5 It is, therefore, compulsory for all the PAOs to first capture the PAN Number details of all the GPF Accounts opened in their COMPACT database and also update their Date of Birth, Date of Joining Govt. Service and Date of Superannuation so that the multiple account numbers of a subscriber could be mapped and unique Id could be allotted. A new upgrade of COMPACT is available at www.pao2000.nic.in. All the 
PAOs have to upgrade their COMPACT before capturing this information. In order to further facilitate in data entry, a separate off-line utility has also been available at www.pao2000.nic. A User-guide for the utility is attached as annexure-1.

6. It is therefore requested to instuct all the PAOs under your control to obtain PAN number and update Account Allotment General Information of all the subscribers under their control latest by 5th October, 2012 so that multiple account numbers of a subcriber could be mapped and unique IDs could be issued to all the Account Holders.

Risk Allowance, Hospital Patent Care Allowance and Patient Care Allowance doubled


The Cabinet today approved revision of rates of Risk Allowance. Hospital Patient Care Allowance and Patient Care Allowance payable to about two lakh entitled Central Government employees to double the existing rates with effect from 1s' September, 2008. The proposed revision in the rates of the Risk Allowance, Hospital Patent Care Allowance and Patient Care Allowance will provide succor to the employees at risk due to the nature of their duties. It will also result in considerable financial savings as compared to the Risk Insurance Schemes/Packages. The financial implication of doubling the extant rate of Risk Allowance, Hospital Patient Care Allowance and Patient Care Allowance would be Rs.42.16 crore per annum, as against Rs.503.26 crore plus service tax (approximately) {Rs.40.50 crore plus service tax per annum for insurance policy and Rs.462.76 crore plus service tax for purchase of annuity} for implementing the Risk Insurance package.  The amount of Risk Allowance, Hospital Patient Care Allowance and Patient Care Allowance would be automatically raised by 25 per cent every time the Dearness Allowance on the revised pay structure goes up by 50 per cent. The proposed revision in the rates of Risk Allowance, Hospital Patient Care Allowance and Patient Care Allowance will benefit certain categories of Central Government employees engaged in duties involving special risks.

Subject: Modified Assured Career Progression Scheme for the Central Government Civilian Employees — Clarification regarding.

Reference is invited to the Department of Personnel & Training OM No.35034/3/2008-Estt.(D) dated 19.05.2009 with regard to Modified Assured Career Progression Scheme (MACPS). Pursuant to the discussions in the meeting of National Advisory Committee held on 17.7.2012 and subsequent meeting on 27.07.2012 held with the Staff Side and in continuation to clarifications issued vide this Department’s O.M. No, 35034/3/2008-Estt.(D) (Vol.II) dated 01.11.2010, it is further clarified as under :

2.(i) Financial upgradation under MACPS in the case of staff who joined another unit / organisation on request:
           This Department’s OM No. 35034/3/2008-Estt.(D) (Vol.II) dated 01.11.2010 provides that in case of transfer ‘including unilateral transfer on request, regular service rendered in previous organisation / office shall be counted alongwith the regular service in the new organisation/office for the purpose of getting financial upgradations under the MACPS. However, financial upgradation under the MACPS shall be allowed in the immediate next higher grade pay in the hierarchy of revised pay bands as given in CCS (Revised Pay) Rules, 2008. It is now further clarified that wherever an official, in accordance with terms and conditions of transfer on own volition to a lower post, is reverted to the lower Post/Grade from the promoted Post/Grade before being relieved for the new organisation/office, such past promotion in the previous organisation/ office will be ignored for the purpose of MACPS in the new organisation/office.

2.(ii) Benchmark for MACP Scheme:
          Para 17 of Annexure-I of the MACP Scheme provide that the financial upgradation would be on non-functional basis subject to fitness, in the hierarchy of grade pay within the PB-I. Thereafter for upgradation under the MACPS, the benchmark of ‘good’ would be applicable till the grade pay of Rs.6600/- in PB-3. The benchmark will be ‘Very Good’ for financial upgradation to the grade pay of Rs. 7600 and above. This Department's OM No.35034/3/2008-Estt(D) (Vol.II) dated 01.11.2010 provides that where the financial upgradation under MACPS also happens to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefit under MACPS as mentioned in para 17 ibid, the benchmark for promotion shall apply to MACP also. It is now further clarified that wherever promotions are given on non-selection basis (i.e. on seniority — cum — fitness basis), the prescribed benchmark as mentioned in para 17 of Annexure — I of MACP Scheme dated 19.05.2009 shall not apply for the purpose of grant of financial upgradation under MACP Scheme.

3. The MACP Scheme issued by this Department vide OM No. 35034/3/2008-Estt.(D) dated 19th May, 2009 stands modified to the above extent.

Subject : Assured Career Progression Scheme (ACPS) for the Central Government Civilian Employees — regarding.

The undersigned is directed to invite reference to the Department of Personnel &Training (DOP&T)'s Office Memorandum of even number dated 09.08.1999 with regard to the Assured Career Progression Scheme for the Central Government Civilian Employees Para 8 of the Annexure-I attached with the Scheme provided as under:

"8. The financial upgradatlon under the ACP Scheme shall be purely personal to the employee and shall have no relevance to his seniority position. As such, there shall be no additional financial upgradation for the senior employee on the ground that the junior employee in the grade has got higher pay-scale under the ACP Scheme".

2. The ACP Scheme was applicable upto 31.8.2008 and was replaced by the Modified Career Progression Scheme (MACPS) with effect from 1.09.2008. As the revised pay scales are applicable w.e.f. 01.01.2006, those employees who received ACP between 01.01.2006 to 31.08.2008 got financial upgradation under ACP Scheme in the revised pay scales.

3. Instances of senior employees who got benefit under ACP Scheme prior to 1.1.2006 and are drawing less pay than their juniors who got benefits under ACP Scheme after 01.01.2006 (i.e. between 01.01.2006 and 31.08.2008) have been brought to the notice of this Department. The issue has been examined in consultation with the Department of Expenditure and it has been decided to allow stepping up of pay in such 
cases where the senior, but for the pay revision on account of 6th CPC, would have continued to draw higher pay, subject to the following conditions:

i. Both the junior and the senior Government servants should belong to the same cadre and the posts in which they have been promoted / fìnancially upgraded should be identical in the same cadre.

ii. The pre-revised scale of pay and the revised grade pay of the lower and higher posts in which they are entitled to draw pay should be identical.

iii. The senior Government servant should have been drawing equal or more pay than the junior before receiving ACP / Promotion.

iv. The stipulations as contained in DOPT’s O.M. No. 4/7/92-Estt.(Pay-I) dated 4.11.1993 along with revision of pay scales may be observed while granting such a stepping up of pay. 

4. All Ministries/Departments may give wide circulation to the contents of this O.M. for general guidance and appropriate action in the matter.

The undersigned is directed to refer to this Departments OM of even number of even number dated 27th April, 2010.
2 In above mentioned OM dated 27th April, 2010, in the light of Orders issued by Honble Supreme Court in the SLP(Civil) No.15770/2009, Union of India Vs. A.K.Goel & Ors., all the Ministries/ Departments were advised that wherever petitions have been filed in the court to grant relief on the basis of the decision of the Supreme Court in Dev Dutt case (Civil Appeal No.7631 of 2002), the latest Orders of the Supreme Court in A.K.GoeI case may be brought to the notice of the Court.
3. The Supreme Court in the SLP in Uttam Chand Nahta’s case (SLP Civil Appeal No.29515 of 2010) by order dated 20/24th December, 2010 not only tagged the SLP with A.K.Goel case but also directed that status quo in the DPC proceedings which was subject matter of dispute before the CAT/High Court, shall be maintained (copy enclosed). In Uttam Chand Nahta’s case, the Supreme Court has duly taken note of Abhijit Dastidar case 2009 (16) SCC 146 while granting stay of the High Court order.
4. In view of above it is reiterated that wherever petitions have been filed in the court to grant relief on the basis of the aforesaid decision of the Supreme Court in Dev Dutt case, the Orders of the Supreme Court in Uttam Chand Nahta's case (SLP Civil Appeal No.29515 of 2010) by order dated 20/24th December 2010 case may be brought to the notice of the Court. While all such petitions are required to be appropriately defended, the "limitation period" for filing review petition should also be strictly followed.

Not necessarily. MACPS benefit is given to immediate higher grade of pay as per the recommended revised Pay Bands and Grade Pay as given in Section 1, Part -A of the First Schedule of Railway Services (Revised Pay) Rules, 2008.

What would be the highest possible Grade Pay, upto which the benefit can be extended?
Upto the maximum Grade Pay of Rs.12000 in PB - 04.

Should there be pay fixat for MACPS?
Pay shall be raised by 3% of the total pay in the Pay Band & Grad Pay, drawn before upgradation.

A Junior Clerk joined in GP Rs. 1900/-, got MACPS benefit in GP Rs.2000/- with pay fixation. Thereafter, he was promoted as Sr. Clerk in GP Rs. 2400/-. What will be the monetary benefit?
There will be no further fixation after MACPS benefit.Only difference in GP (Rs. 1900 to Rs.2800/-) is payable.

Should there be pay fixation at the time of regular promotion after getting MACPS benefit?
At the time of actual promotion, even it happens to be in a post carrying higher Grade Pay than what is available under MACPS, no pay fixation would be available. Only difference of Grade Pay would be made available.

What would be the steps for pay fixation in this scheme?
i) 23.08.1996 - A person joins Rly. Service (GP-Rs.1900/-); ii) 01.09.2008 - Eligible for MACPS benefit, if not promoted (Oncompletion of 10 yrs & effective wef 1.9.08 iii) Pay should be fixed by granting him one increment (3%) plus the difference of grade pay (Rs.2000-Rs.1900= Rs.100/-)

Will promotions that were earned or upgradations that were granted due to ACP Scheme carry same GP due to merger of pay scales or upgradations of posts shall be counted?
No. It should be ignored.

In a case - A Railwayman recruited in paysale Rs.5000-8000-/-(Pre-revised) did not get promotion after 25 years of service prior to 1.1.86 got 2 ACP Scheme Upgradations in Rs.5500-9000/- and 6500-10500/-. What will be the grade pay as per MACPS?
a). Recruitment grade pay - Rs.4200/(PB-2) b). For 10 yrs regula service, GP Rs.4600/- (PB-2), c). For 20 yrs service, GP Rs.4800/ (PB-2)

In a case - A Railwayman recruited in pay sale Rs.5000-8000-/-(Pre-revised) and got two promotions in 25 years of service in Rs.5500-9000/- and 6500-10500/-. What will be the grade pay as per MACPS?
Recruitment and next promotion were in PB 2 and GP 4200/-. Therefore, the employee is eligible for (1) one upgradation to GP Rs.4600/-(PB-2) for 10 yrs regular service and (2) another upgradation to Rs.4800/-(PB-2) for 20 yrs. regular service.

What will be the reference pay for revision as per VI CPC in case of the employees, who got the benefit of ACPS till 01.01.2006?
Revised pay will be with reference to the pay scale granted to them under the ACPS.

What should be done for the employees, who have got the benefit of ACPS between 01.01.2006 to 01.09.2008?
Such employees has the option to have his pay fixed with reference to pre-revised pay either (a) wef 01.01.2006 or (b) wef date of financial upgradation underACPS. In case of (b) the employee will be eligible for arrear from the date of his/her option,

The Railwayman can exercise option under Rule 1313(1)(a)(i) of IREC Vol.II[FR22(1)(a)(i)]- to fix pay in higher grade pay either from the date of upgradation or from the date of next increment. The pay and date of increment would be in accordance with clarification

In case of promotions earned in the post carrying same grade pay in the promotional hierarchy as per recruitment rules, what should be the MACPS Benefit ?
Such promotions with same grade pay shall be counted for the purpose of MACPS.

Should grade pay of Rs.5400/- in PB-2 and PB-3 be treated as separate grade pay for MACPS?
No. Same grade pay with different pay bands will be treated as separate grade pays for MACPS.

Period of service that commences from the date of joining post in direct entry grade on a regular basis either on direct recruitment basis or on absorption/re- employment basis.

No. Such period shall not be taken into reckoning.

Yes. Previous service in another department will be counted for MACPS (but not regular promotion).

Competent administrative authority to decide, whether to retain such schemes or to switchover to MACPS. However, both the schemes shall not run concurrently.

Competent authorityof such body and Ministry of Railways would decide.

In a case – a Group A employee, not covered under ACPS has become entitled to 3rd financial upgradation directly. How his pay should be fixed?
His pay shall be fixed successively in next three immediate higher grade pays in the hierarchy of revised pay bands and grade pays allowing the benefit of 3 % pay fixation at every stage.

If an employee, declare surplus in his department, is appointed in the same pay scale or lower scale of pay in new organization, how MACPS be implemented?
The regular service rendered in previous organization shall be counted towards regular service in the new organization for the purpose of giving up-gradation under MACPS.

Will an employee be eligible for this benefit in case s/he after getting promotion/ACP benefit seeks unilateral transfer to a lower post/scale?
The employee will be entitled for 2nd and 3rd up-gradations on completion of 20 & 30yrs. of regular service from the date of initial appointment to the post in the new organization.

What will be the fate of those employees who refused regular promotion?
No financial up-gradation shall be allowed as such an employee has not been stagnated.

What will be the fate of those employees who has got financial up-gradation due to stagnation and subsequently refused the promotion?
The employee will not be eligible to be considered for further financial up-gradation till he agrees to be considered forpromotion again and the 2nd and next financial up-gradation shall also be deferred to the extent of period of debarment due to refusal.

How the scheme will be applicable to ad hoc employees?
Such employees would be allowed the benefit considering his/her notional pay to the substantial post and the pay will be fixed considering the benefit of this scheme vis-à-vis pay drawn on ad hoc basis.

Should the deputationists be reverted to parent department for this benefit?
No. S/he may avail MACPS benefit and exercise a fresh option to draw the pay in his deputation or the pay as per MACPS.
